Why Punta Gorda Storm Claims Need a Public Adjuster

Punta Gorda has taken hurricanes two ways. Charley's eye crossed the city in 2004, and its eyewall hit with what the National Hurricane Center called devastating results; Ian made landfall near Punta Gorda in 2022. In 2024, Helene and Milton brought storm surge up Charlotte Harbor instead.

FEMA's flood data looks different for each pair of storms. In ZIP code 33950, which holds the largest share of the city's land, 319 of Charley's 339 flood claims and 167 of Ian's 193 had no building payment. In the same ZIP code, FEMA ties 789 claims to Helene and 1,134 to Milton.

We sort every piece of damage by storm and by wind or water, compare it with what NOAA and the hurricane center recorded around Punta Gorda, and send it to the coverage that answers for it. Our pages on flood claims and hurricane claims go into each.

In Charlotte County, Charley did catastrophic wind damage, while most of Helene's damage came from storm surge, according to the National Hurricane Center.

Punta Gorda Claims Under Florida Law

Punta Gorda's recent hurricanes straddle a 2022 change to the state's notice statute. The full rules are on our state page.

Ian and the 2024 hurricanes run on different notice clocks627.70132
Florida measures a hurricane claim's notice period from landfall. For Ian in 2022, the statute then in force allowed 2 years for notice and 3 years for supplemental claims, and both have run. A policy renewed or first issued after December 16, 2022 allows one year to report and 18 months for supplemental claims, and for Helene and Milton claims under those policies, both have passed too.
A calendar-year hurricane deductible for Helene and Milton627.701
FEMA's data ties 2,670 Charlotte County flood claims to Helene and 3,511 to Milton. On the wind side, the hurricane deductible for personal residential coverage from the same company or group of companies is an annual figure, met once in a calendar year. When Milton followed, the insurer could apply whichever was higher: the part still unmet, or the all-other-perils deductible.

Punta Gorda Neighborhoods We Serve, From the Harbor to Shell Creek

Each part of Punta Gorda met the wind and water in its own way. Here is what the storm records show.

Downtown, Fishermen's Village and the Peace River

Where the harbor comes into town

NOAA's storm record puts a foot of water in downtown Punta Gorda during Frances in 2004 and 1.5 feet during Jeanne later that month, with Charlotte Harbor tides 5 to 5.5 feet above normal. Idalia's flooding closed US 41 at the Peace River Bridge in 2023, and Milton's surge flooded Fishermen's Village near the mouth of the Peace River. The City lists the low-lying area of older buildings along the Peace River as one of its two repetitive loss areas.

Punta Gorda Isles and Burnt Store Isles

Canal neighborhoods and seawalls

The City counts 45 miles of canals and inlets and 91 miles of seawalls in its canal system, which is split into two maintenance districts, Punta Gorda Isles and Burnt Store Isles. During Irma in 2017, Charlotte County emergency management reported that seawalls collapsed when water drained out of Charlotte Harbor ahead of the storm, and NOAA's record puts $20 million of the county's damage on 15 miles of fallen seawall. Milton's surge reached 5 to 8 feet above ground in the northern part of Charlotte Harbor.

Pirate Harbor, Charlotte Park and Burnt Store Marina

Ian's landfall, south of the city

NOAA's record places Ian's second Florida landfall just south of Punta Gorda, near Pirate Harbor, on September 28, 2022. A USGS sensor in Pirate Harbor recorded water 4.47 feet over mean higher high water, and the hurricane center found that most sensors placed in Port Charlotte and Englewood stayed dry because of offshore winds. At least 200 homes were destroyed in Charlotte County.

The Airport, Shell Creek and Tuckers Corner

Inland wind and river water

Punta Gorda's airport weather station measured a 97-knot gust in Charley before its wind sensor failed, and a 117-knot gust in Ian before it stopped reporting wind. A USGS streamgage at Shell Creek near Punta Gorda read 1.42 feet higher during Milton than during Helene two weeks earlier, and a Milton tornado near Tuckers Corner overturned a camper and damaged a structure. In 2017, NOAA logged a tornado that flipped a pickup truck in a farm area of Punta Gorda, east of Aspen Road.

Punta Gorda Claim Choices: Hire an Adjuster, Hire a Lawyer or Go It Alone

A Punta Gorda storm claim starts with whether wind or water did the damage, and that takes evidence.

Insurance Lawyer

For legal disputes
  • Lawsuits over coverage, bad faith and the meaning of policy language.
  • A dispute over the amount of loss can go to appraisal when the policy provides it, without a lawsuit.

On Your Own

One storm, one clear loss
  • Workable for a small loss with a single, obvious cause.
  • Tougher on flood claims: of Charlotte County's 811 Charley flood claims, 767 had no building payment.

Punta Gorda Storm Losses We Handle

Each loss type below is backed by a NOAA, FEMA, hurricane center, City of Punta Gorda or Florida Statutes source.

Storm

Hurricane Wind: Charley and Ian

According to the National Hurricane Center, Charley did catastrophic wind damage in Charlotte County, and Punta Gorda's airport station logged a 117-knot gust in Ian. Wind damage is claimed on the homeowners or windstorm coverage, and Fla. Stat. 627.4025 ties the hurricane deductible to losses a hurricane causes. More on wind damage claims.

Storm

Harbor and River Surge

Milton's surge reached 5 to 8 feet above ground in northern Charlotte Harbor and along the Peace River, and FEMA puts 3,110 of the county's 3,511 Milton flood claims in flood zone AE, with 343 in zone VE. See our flood damage claims page.

Regional

Seawall Collapse

Punta Gorda's two canal districts cover 91 miles of seawalls. During Irma in 2017, water drained out of Charlotte Harbor ahead of the storm, and Charlotte County's damage estimate included $20 million for 15 miles of seawall that collapsed.

Regional

Tidal Flooding Downtown

Idalia's water closed US 41 at the Peace River Bridge in 2023 and left 12 Charlotte County roads impassable from saltwater, and 66 structures in the county had major damage.

Common

No Building Payment on the Flood Claim

Across Charlotte County, 4,225 of the 11,697 NFIP claims had no building payment, and FEMA recorded code 06, not actual flood, on 957 of them.

Specialty

The City's 50 Percent Rule

Inside city limits, when repairs to a flood-zone building that does not meet current elevation rules cost 50% or more of its market value, land excluded, the building must be brought into full compliance unless a historic-building exception applies. In A zones that means a finished floor 1 foot above base flood elevation, and the City counts contractor overhead and profit toward the cost.

Specialty

Back-to-Back 2024 Hurricanes

Helene and Milton reached Punta Gorda two weeks apart, and the annual hurricane deductible rule of Fla. Stat. 627.701 can decide how much deductible the Milton claim carries.

How a Punta Gorda Claim Is Built

Every step rests on the record from the step before it.

1

Date the storm

A hurricane loss is dated to landfall under Fla. Stat. 627.70132, so a Punta Gorda claim starts by matching each repair to a storm, which matters when Helene and Milton hit the same property two weeks apart.

2

Check the damage against the record

Water lines are compared with Milton's 6-foot high-water marks near the Punta Gorda marina, and roof and window damage with the gusts measured at the airport.

3

Price the repairs

We estimate each repair under the coverage that pays for it, including code work and the costs the City counts toward its 50% rule.

4

Watch the 60-day clock

The insurer must pay or deny within 60 days of getting notice, per Fla. Stat. 627.70131, and we log that date in writing.

Our state page lays out the statutes in its Florida claim rights section. For nearby cities, see our Port Charlotte and North Port pages, or our Cape Coral page to the south.

Punta Gorda Public Adjuster FAQ: Charley, Ian and Milton

Did Hurricane Charley's eye pass over Punta Gorda?
Yes. The National Hurricane Center puts Charley's eye over Punta Gorda at about 2045 UTC on August 13, 2004, with the eyewall striking the city and Port Charlotte. The Punta Gorda airport station measured a 97-knot gust before its wind sensor failed.
Where did Hurricane Ian make landfall near Punta Gorda?
Ian came ashore near Punta Gorda at 2035 UTC on September 28, 2022, with estimated winds of 125 knots, an hour and a half after its landfall on Cayo Costa. NOAA's storm record places that landfall just south of the city, near Pirate Harbor.
How high was Hurricane Milton's storm surge in Punta Gorda?
The National Hurricane Center estimates 5 to 8 feet above ground in northern Charlotte Harbor and along the Peace River, and NWS crews found 6-foot high-water marks in the Punta Gorda marina area. NOAA's record also notes surge flooding in Fishermen's Village.
How many flood claims came from Charlotte County after Helene and Milton?
Charlotte County has 2,670 NFIP claims tied to Helene and 3,511 tied to Milton in FEMA's data, which shows no building payment on 471 of the Helene claims and 654 of the Milton claims.
How many FEMA registrations named Punta Gorda after Charley and Ian?
FEMA holds 20,360 valid Charley registrations and 17,098 Ian registrations that list Punta Gorda as the damaged city. FEMA recorded habitability repairs as required on 11,155 of the Charley registrations and 3,242 of the Ian registrations.
What is the 50 percent rule in Punta Gorda?
Inside city limits, when repairs or improvements to a building in a flood hazard area cost 50% or more of the structure's market value, land excluded, the building must meet current flood rules unless a historic-building exception applies. In A zones that means a finished floor 1 foot above base flood elevation.
Does Milton get its own hurricane deductible if Helene already hit my Punta Gorda home?
Fla. Stat. 627.701 makes the hurricane deductible on home coverage from one company or company group a yearly amount, so if the same insurer covered both storms, Helene and Milton share the 2024 deductible. On the Milton claim, the insurer can charge whichever is larger: what is left of that deductible, or the all-other-perils deductible.
How much does a public adjuster in Punta Gorda charge?
On a residential or condominium unit owner claim, Fla. Stat. 626.854 caps a public adjuster's fee at ten percent of claim payments on a claim tied to a state of emergency the Governor declared, made within one year of the declaration. Without a declared emergency, or on a claim made after that year, the cap is twenty percent. There is no upfront fee.

Punta Gorda Claim Paid Short? Check These Three Things

A short payment on a Punta Gorda storm claim can be traced to a decision about cause, scope or timing.

1

Ask for the written reason

Charlotte County's flood data shows code 06, not actual flood, on 957 of the 4,225 claims with no building payment, so start with the reason the insurer gave.

2

Split wind from water

Punta Gorda has had hurricane-force wind from Charley and Ian and harbor surge from Helene and Milton, and each repair needs a cause and a storm before it can be priced.

3

Check the 50% math

If the City treated the building as substantially damaged, compare the repair cost behind that decision with the estimate the insurer paid.

Send the insurer's letter explaining the payment and the declarations page from your policy, and we will point to which of the three fits. Set up a free claim review.

Punta Gorda FEMA Aid and Insurance Claims Are Separate

FEMA's Individual Assistance program is disaster aid, not an insurance payment. After Ian, FEMA recorded habitability repairs as required on 3,242 registrations listing Punta Gorda, and that record stays separate from your flood or homeowners claim.

Registering with FEMA does not notify your insurer. For the insurance side, see our hurricane claim page.
